Architectural Guidelines

PURPOSE:

The following guidelines have been established pursuant to Article 14 of the Declaration of Covenants, Conditions and Restrictions for the Oakwood Homeowners Association in order to direct the Board of Directors and/or Architectural Committee making decisions approving or disapproving architectural plans submitted to it pursuant to Article XI of the By-Laws of the Oakwood Homeowners Association, and when deciding upon appropriate corrective actions against non-conforming architectural changes.

The further purpose of the guidelines is to provide homeowners with directions when planning or considering architectural and drafting plans and specifications to be submitted to the Board of Directors or Architectural Committee for approval.  These guidelines do not supersede the governing legal documents of Oakwood Homeowners Association.  Furthermore, the homeowner is responsible for ensuring all submittals meet all applicable zoning and regulatory codes and permitting requirements.

The following guidelines are intended to assist the maintenance of harmonious exterior design, materials, decoration, color, and locations of all architectural changes.  The harmony will retain the aesthetic and economic value of individual properties, as well as the entire Oakwood Community.  The guidelines are intended to be broad enough to allow each property owner to exercise individual taste, but to provide a broad parameter within which all architectural changes must fit.

All architectural changes must be submitted to the Board of Directors in writing for approval unless this document specifically states that submittal is unnecessary.  Submittals which do not conform to the guidelines will be evaluated on an individual basis and the owners should be aware that the submitted change may not be approved.

All decisions will be made without regard to the requesting homeowner's race, creed, color, sex or religious beliefs.

SPECIFIC GUIDELINES:

I.     All fences, decks, mailboxes, patios, additions, etc., (including anything that can be construed as a permanent structure) must be submitted to the Board for architectural approval prior to construction.

A.     FENCES

1.     Height: 4 ft. min. - 8 ft. max.

2.     Exterior grade wood materials: pressure treated pine, redwood, cedar, etc.

3.     Natural color: no painting of fences.  Wood stain colors are acceptable, but must be coordinated with the other exterior colors of the home.

4.     No brick or stone fences.

5.     Wrought Iron fences may be allowed, with prior approval of the Board.

6.     Invisible fencing may also be installed.  The Homeowner assumes full liability and responsibility for installation and maintenance of invisible fencing.

7.     Horizontal fence supports should be on the interior fence perimeter.

8.     Under no circumstances will wire style fences be permitted in sight of the street.  However, the Architectural Committee will review vinyl coated, chain link, fences which are not visible from the street or another property on an individual basis.

B.     DECKS

1.     Exterior grade wood materials: pressure treated pine, redwood or cedar.

2.     Natural color: no painting of decks.  Wood stain colors may be acceptable, but must be coordinated with the other exterior colors of the home.

3.     Visibility:  cannot be visible while standing in front of house (including stairs off deck) unless topography dictates otherwise.

C.     MAILBOXES

1.     Height restriction:  5 ft.

2.     Materials:  Wrought iron (consistent with colors of house, i.e., white, antique gray or black); face brick-must match that of house brick; exterior grade wood material - cannot be painted if it is wood.

3.     If the mailbox and/or post are painted, they must match the color scheme of the house.

4.     The house number must be on the post, a sign, or on the mailbox itself.

D.     PATIOS

1.     Visibility:  not to be visible from the front of the house.

2.     Materials:  concrete, pea gravel, stone, face brick, or brick pavers.

E.     ADDITIONS

        Additional rooms, screened in back porches must be submitted to the Board with detailed drawings before any construction takes place.

F.     SATELLITE DISHES AND ANTENNAE:  REFER TO SEPARATE POLICY

G.     SHEDS

1.     Rear yard behind building.

2.     Colors consistent with neighborhood.

3.     192 sq. ft. max. (typical 12' x 16').

4.     Not visible while standing in front of house.

5.     No higher at ridge than 12'.

6.     Must be within the building envelope of the house and comply with all applicable codes and permitting requirements.

II.     Temporary and/or permanent lawn fixtures within street view must be submitted to the Board for architectural approval.

1.     Plastic, wood, concrete, and metal lawn fixtures in any form - i.e. deer, birds, flamingos, lions, etc., not allowed.

2.     Trellis must be attached to house or within 24" of house.  Color: natural, white, or can match the color of the trim on the house.

3.     Landscaping lights:  must be placed within 18" of the sides of a driveway, porch, sidewalks, and planting beds along the perimeter of the house.

4.     No birdhouses or feeders in the front of the house.

5.     No play equipment such as swing sets, sandboxes, basketball goals, tire swings, etc., shall be located in front of, or attached to, the front or side of a house.

III.     Temporary and/or permanent fixtures located in the rear yard must also be submitted to the Board for architectural approval, but will be given greater leniency in consideration:

1.     No chain link dog runs unless entirely enclosed within a privacy fence.

2.     If a homeowner is going to have a pet that will be housed or chained outside all day, then the homeowner must have a fenced-in rear yard.

3.     Play equipment, such as swing sets, sandboxes, basketball goals, tire swings, etc., shall be permitted in the rear yard.  In addition, play equipment located in the rear yard does not require Board approval.  (See Section II, Item 5 above.)

 

ANTENNAE AND SATELLITE DISHES

POLICY

All television antennae, satellite dishes, dishes which receive video programming services via multipoint distribution services and any other device used for the reception of television broadcast signals, direct broadcast satellite services or multi-channel multipoint distribution (wireless cable) services must be one (1) meter or less in diameter.

Antennae must be located to the rear of a Lot and not visible from the street (unless such location would preclude reception of an acceptable quality signal) and may not be affixed to any portion of the Common Area.

Freestanding antennae must be attached to and located behind the rear wall of the main residential structure.  No antenna may be erected on a wooden poll.

Television antennas must be located to the rear of the roof ridgeline, cable or centerline of the principal dwelling.
